1. WHO WE ARE

  • www.oliverpeople.com (hereinafter, the “Website”) uses cookies and other technologies to ensure the proper functioning of the Website and to improve your browsing experience.

    The purpose of this cookies policy (hereinafter, "Cookie Policy” or, simply, “Policy”) is to familiarize you with these technologies, to inform you about the cookies that we Luxottica Group S.p.A. with registered office at Piazzale Cadorna no. 3 – 20123 Milan, Italy (hereinafter, “EssilorLuxottica”, or “we”, or “us”, or “our”) as Data Controller placed on the Website, how we use them and how you can control them.

    This Policy should be read in conjunction with our Website Privacy Policy, which contains the necessary information on how we process your Personal Data, including that which may be collected by cookies where applicable. Please also refer to section 1.3 of such a policy for what concerns the definition of “Personal Data” and “Data Controller”.

2. WHAT ARE COOKIES?

  • A cookie is a small text file, usually consisting of letters and numbers, which is transferred by us on your device (computer, tablet, smartphone or any mobile device) and stored therein for a determined period of time. For example, there are cookies uniquely identifying a device, distinguishing it from another.

    Please note that other technologies similar to cookies (such as pixel tags, web beacons or social network plug-ins) are also used to collect information about the device you are using. These technologies also fall into the general category of “cookies” under this Cookie Policy.

    Please note that we also use pixels or web beacons in our direct marketing emails that we may send to you, if you have consented to receive them. Such pixels track whether our email was delivered and opened, and whether the links contained therein were clicked. They are not stored on your device but are invisibly embedded in the Website pages.

3. WHY DO WE USE COOKIES?

  • We use cookies for different purposes.

    Some cookies are absolutely necessary to allow the Website to function properly and provide you with a good browsing experience, such as moving in a simple way from one page of the Website to another and providing you with the services envisaged therein (e.g. purchasing glasses and making payments).

    Other cookies are necessary to make browsing easier and faster (e.g., by remembering registration data or the contents of the shopping cart), or to make browsing as much in line as possible with your preferences and characteristics.

4. WHAT INFORMATION DO COOKIES CONTAIN?

4.1 Storage duration

  • Based on how long cookies are stored, we can distinguish between the two following categories:

    • Session cookies, which are the cookies installed when the Website is opened and which are deleted when the browser is closed, or when the Website is closed, or when the session expires. The information is thus stored temporarily and allows, for example, navigation to be maintained.
    • Permanent cookies, which are the cookies that remain stored on your device even after having closed the browser for a defined period of time which is predetermined by us. 4.2 Cookies source

  • Cookies can be also classified based on the source they come from. In this context, we distinguish between two categories of cookies: 

    • Proprietary (or “First-Party”) cookies, which are cookies that are created by the Website you are visiting, and which are associated with its domain name.
    • Third-Party cookies, which are cookies that are created by our third-party suppliers but placed on the Website by us and are therefore associated with a different domain name from the Website where they are implemented on. With respect to our third-party partners, they set cookies when you are logged onto their pages, or when you visit our Website, for example in the form of an advertising banner.

4.3 Cookies purposes

  • Based on the purposes for which cookies are installed on the Website, they can be classified in the following categories:

6. WHO HAS ACCESS TO THE INFORMATION COLLECTED VIA COOKIES?

  • With reference to the cookies installed by us, only our personnel in charge, duly trained and instructed to carry out such tasks, may access the information collected through cookies.

    With reference to third-party cookies, information is collected and used by us and by the external parties linked to us by a contractual relationship. 7. IS YOUR PERSONAL DATA TRANSFERRED ACROSS THE BORDER?

  • Your Personal Data collected through cookies may be processed, accessed or stored outside your country of residence.

    As a result of the above, your Personal Data may be accessed from and/or transferred to countries which do not have data protection laws ensuring to your Personal Data a level of protection equivalent to that existing within the European Economic Area.

    In such cases, we ensure that, at all times, that appropriate safeguards are implemented to ensure that your Personal Data is processed in accordance with applicable data protection legislation. In this respect, where your Personal Data is processed by another entity belonging to the group we belong to (the EssilorLuxottica Group, as defined in the Privacy Policy; entity(ies) belonging to the EssilorLuxottica Group are hereinafter referred to as “EssilorLuxottica Entity(ies)”), the safeguards are based on the commitments taken on the basis of (i) a dedicated transfer agreement binding upon the EssilorLuxottica Entities involved in the processing, and (ii) a set of common rules applied in the entire EssilorLuxottica Group through the EssilorLuxottica Group Data Protection Policy, which sets the rules governing the processing of Personal Data inside the EssilorLuxottica Group in compliance with applicable laws and regulations.

    Where your Personal Data is processed by EssilorLuxottica Entities or third parties located outside the European Economic Area, we ensure that specific contractual protection is implemented so that that this requirement is addressed in accordance with the applicable laws and regulations as per Articles 44 et seq. of the EU Regulation 2016/679 (the so-called General Data Protection Regulation, hereinafter “GDPR”).
